Who we are
This website belongs to Annahess, a series of NextCTR LLC, and runs on the Shopify platform. Throughout these Terms of Service, "we", "us" and "our" refer to Annahess. Visiting the site or placing an order means you accept these Terms together with our Privacy Policy; anyone who does not accept them may not use the site or its services.
Eligibility and your information
Using the site means confirming you are at or above the age of majority in your home state or province. Please keep the details you give us, including your email address and your billing, payment and shipping information, accurate, current and complete. Whoever places an order confirms they are authorized to use the payment method selected and that its issuer will honor the charge. Account holders are responsible for keeping their login details private.
Product information, pricing and errors
Product photos and descriptions aim to show color and detail faithfully, but displays render color in their own way, so what your device shows may not match the item exactly.
Our prices may change without notice and, unless stated otherwise, do not include state or local sales tax.
We may restrict quantities, limit sales to certain customers or regions, and withdraw any product at any time. The site may occasionally contain a typo, an inaccuracy or an omission in a description, price, promotion or availability detail. When we find one, we can fix it, refresh the details or cancel the orders it affects, without notice.
Orders
Each order you place counts as an offer to purchase, which we are free to accept, limit or refuse for any reason. Processing starts soon after checkout, so an order can be changed or canceled only within 2 hours of being placed. An order that has already been processed falls under our Refund and Return Policy.
Delivery, loss and damage
We are not liable for delays caused by carriers, bad weather or other circumstances beyond our control, and delivery dates are estimates.
While in transit, your parcel remains our responsibility. Should it disappear before delivery or arrive damaged, write to support@annahess.com. Where the inquiry with the carrier shows the parcel was lost or damaged, we provide a replacement or a refund under our Shipping Policy. Claims about damaged or defective items must be made within 7 days of delivery, following our Refund and Return Policy.
The moment the carrier scans your parcel as Delivered at the address given during checkout, risk of loss passes to you. After the scan, Annahess has no liability for loss or theft. A delivery that fails because the checkout address was incomplete or incorrect is handled under the Failed delivery section of our Shipping Policy, and sending it again may involve a fee.
Intellectual property and feedback
Annahess or its licensors own the text, images, graphics, logos, page design and other content on this site, which is protected by copyright law and other intellectual property laws. Copying, reproducing, selling or otherwise exploiting any of it requires our written permission first.
Anything you send us as feedback, whether an idea, a suggestion or a review, may be used, edited, copied and published by us in any medium, with no restriction, no payment to you and no duty to keep it confidential.
Acceptable use and outside links
The site is for lawful use. Nobody may use it, or its content, to: (a) infringe intellectual property rights, whether ours or a third party's; (b) mislead anyone with false information; (c) upload or spread malicious code; (d) harvest personal information about other users; or (e) disrupt the site or anyone's use of it.
Links on the site may lead to third party websites. Annahess has no control over those websites and is not responsible for their content or for any harm connected with goods, services or resources obtained from them.
Shopify and privacy
Shopify hosts the store and supplies the platform, but every purchase is a contract between you and Annahess. Shopify has no part in that contract and is not responsible for claims about products bought here. Our Privacy Policy covers personal information collected through the store, and Shopify also processes information so it can provide the platform. Using the site means you acknowledge these practices.
Warranty disclaimer and limits of liability
The website and the services provided through it come "as is" and "as available", and we do not warrant uninterrupted, error free or fully secure operation. This covers the website and services only, not the products you buy. Nothing here reduces the rights consumer protection law gives you, such as implied warranties that cannot legally be excluded, and the Refund and Return Policy describes the remedies for damaged, defective or incorrect items.
To the extent the law permits, and except for liability that cannot be limited by law, Annahess, together with its directors, officers, employees and suppliers, bears no liability for indirect or consequential losses, or for incidental or special damages, that result from using the site or its services.
You will indemnify and defend Annahess, NextCTR LLC and their affiliates, partners, officers, directors, agents, contractors and employees, and hold them harmless, from third party claims and demands, reasonable attorneys' fees included, arising out of a breach of these Terms by you, a law you break, or rights of others that you infringe.
Resolving disputes
This section changes how a dispute between you and Annahess is resolved, so please read it with care. Any claim or dispute that relates to these Terms or to an Annahess purchase will be decided through binding arbitration on an individual basis, not in a court. The American Arbitration Association (AAA) runs the arbitration using its own rules. Both you and Annahess give up any right to have a jury decide the dispute, and neither side may start or take part in a class action, a class arbitration or any other representative proceeding.
Texas law governs these Terms and any other agreement for services between you and us: the laws of the State of Texas apply.
Severability and updates
If a court or arbitrator decides that a provision of these Terms is unlawful, void or unenforceable, that provision is limited or removed only as far as necessary, and every other provision keeps applying.
We may amend these Terms at any time by posting the amended version on this page, so please look at it from time to time. If you continue using the site after an amendment is posted, you accept it.
